Welcome to The Swissquote Store Website, the-swissquote-store.com (the “Website”). The Website is exclusively owned by Swissquote Bank Ltd (“Swissquote”, “we”, “us”). By accessing the accessing and using the Website, you acknowledge that you have read, understood and agreed to be bound by these terms of service (the “Terms”). Furthermore, you accept that Swissquote may amend these Terms at any time and without prior notice. If you do not agree to these Terms, you are required to leave the Website and refrain from using it.

 

1.          Scope and description of Services

 

1.1.      Subject to the terms and conditions hereunder, we offer you information regarding official Swissquote merchandising products (a “Product”, “Products”) and allow you to purchase such Products through the Website. These Terms therefore also apply to any purchase order and/or transaction made via the Website.

 

1.2.      The Website also allows you, without limitation, to establish an account (“Swissquote Store Account”), sign up for Product waitlists and/or newsletter, participate in promotions, submit feedback or otherwise interact with us (together with the use of the Website and the purchasing of Products, the “Services”).

 

1.3.      For the avoidance of doubt, the Swissquote Store Account as well as your activity on the Website are entirely separate from Swissquote banking accounts.

 

1.4.      The range of Products and Services available on the Website is exclusively intended for users and customers whose place of residence or place of business is Switzerland. If you are a resident of or domiciled outside of Switzerland, you confirm that you access the Website on your own initiative and without any solicitation from Swissquote or from any of its business partners.

 

2.          No offer or advice

 

2.1.      Any information provided on the Website, transmitted to you or obtained via any functionality of the Website or the Products is for information purposes only. Such information should in no event be construed as an offer, advice or a recommendation to buy or sell a particular financial instrument or to engage in any transaction whatsoever. No information provided, transmitted or obtained through the Website should be construed as an advice of any kind, including as financial, legal or tax advice.

 

3.          Personal protection and collection

 

3.1.      When you visit the Website and use the Services, we collect and process your data. Data-related aspects are dealt with in more details in the Privacy Policy available at https://the-swissquote-store.com/en/policies/privacy-policy and which is incorporated by reference into these Terms. You agree to the Privacy Policy by accessing the Website or using the Services.

 

4.          Contract for Product purchase

 

4.1.      Product and price

 

4.1.1.       Images of Products in advertising material or on the Website serve illustrative purposes only and are non-binding.

 

 

4.1.2.       All sales prices published on the Website are final prices, inclusive of VAT, packaging costs, and any other taxes, fees, or costs all taxes (notably VAT). In addition to the final price, a delivery charge of CHF 4.90 applies for order totals of below CHF 80.00. For orders totals of CHF 80.00 and above, delivery is free.

 

4.1.3.       Swissquote reserves the right to change prices of Products and Services at any time. The prices stated on the Website at the time of purchase order placement apply.

 

4.1.4.       Products are available for as long as they can be found through the search engine on the Website and/or while stocks last.

 

4.2.      Availability and delivery times

 

4.2.1.       Swissquote is committed to providing up-to-date and precise information on availability and delivery times to you. However, production and delivery shortages in particular may cause delivery delays for Swissquote. Therefore, all information on availability and delivery times displayed on the Website is subject to change.

 

4.2.2.       Products can only be shipped to you and cannot be collected. We only deliver to addresses in Switzerland. We are unable to accept orders for shipping outside of Switzerland.

 

4.3.      Contract conclusion

 

4.3.1.       Products and prices stated on the Website are deemed to constitute offers.

 

4.3.2.       You are responsible for verifying the delivery recipient’s name, address, items, quantities and size carefully before placing an order. Please note that the order and delivery address usually cannot be changed after you place it.

 

4.3.3.       The purchase contract is concluded between you and Swissquote as soon as you have placed an order on the Website. Once you place the order, we will automatically e-mail you an order confirmation.

 

4.4.      Payment

 

4.4.1.       Payments must be made in Swiss Francs (CHF). Cash payments are not possible.

 

4.4.2.       Delivery is made only after receipt of the payment. Once the payment is done, the order can no longer be cancelled or changed.

 

5.          Return and exchange policy

 

5.1.      Products purchased on the Website are not refundable. Exchanges are possible if the Product delivered presents a defect, a damage or is a different size or model than what was in your order.

 

5.2.      You are obliged to immediately inspect the delivered Products for correctness, completeness and potential transport damage. You shall inform Swissquote of any defects, or false or incomplete deliveries, immediately after detection thereof and within five calendar days after delivery at the latest. You acknowledge that this information first needs to be given by e-mail at: the-swissquote-store@swissquote.com. Products sent back to us without first requesting an exchange by e-mail will not be accepted.

 

5.3.      If we confirm, by return of e-mail (“Swissquote’s confirmation e-mail”), that your Product is eligible for exchange, you must ship the Product, unworn, with tags attached, in its original condition and packaging, at your expense, to the following address, within 14 calendar days of Swissquote’s confirmation e-mail:

5.4.      Once we have received, inspected and approved your Product, we will ship you the exchange Product free of charge to the address indicated in your initial order.

 

6.          Limitation of liability

 

6.1.      If we have reasonable grounds to suspect that you have provided us with information that is untrue, inaccurate, incomplete, outdated or have violated these Terms, we may refuse all current or future use of the Services and disable your Swissquote Store Account.

 

6.2.      Neither we nor our directors, officers, employees, agents or shareholders will assume any liability for any loss or damages whatsoever, direct or indirect, incurred as a result of accessing the Website or using the Services, or the inability to do so; in particular, as a result of errors, technical or otherwise, transmission failures, system overloads, usage problems, interruptions in services (including but not limited to system maintenance services), any delay in the transmission of information, incompatibility between the Website and your files, software (in particular your browser) and/or device, the malfunction, interference, the transmission of a virus onto your device, unauthorized access (e.g. as a result of hacking or piracy activities), the wilful blocking of telecommunications tools or networks (as a result of mail-bombing, DoS attacks etc.) or any other failure or inadequacy on the part of telecommunication or network service providers.

 

6.3.      In the event that any Product available on the Website is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for the Product listed at the incorrect price. We reserve the right to refuse or cancel any such orders whether or not the order has been confirmed and your chosen payment method charged. If your chosen payment method has already been charged for the purchase and your order is cancelled, we shall issue a credit to that payment method in the amount of the incorrect price.

 

6.4.      We reserve the right to refuse service to anyone or discontinue any Product for any reason at any time.

 

6.5.      Although we try our best to ensure the accuracy of the Website, we cannot be held responsible for any errors, omissions, or inaccuracies.

 

7.          Your obligations and liability

 

7.1.      You must keep your Swissquote Store Account login data and any other personal information secret, not disclose it to other persons and not store it together with or in the device used to access your Swissquote Store Account. You shall take appropriate measures to protect your Swissquote Store Account from unauthorised access, in particular by choosing a secure password, using up-to-date browser versions as well as anti-virus software/measures and not use a public WIFI network. You shall be solely responsible should your login data be discovered by a third party and, where applicable, for their abusive use and any related losses and damages of any kind.

 

7.2.      All actions, especially placing orders, which are processed via your Swissquote Store Account, are attributed to you. You are liable in particular for orders placed via your Swissquote Store Account.

 

8.          Outsourcing

 

8.1.      For the purpose of outsourcing all or part of our activities related to the Website and/or the Services, Swissquote is entitled to procure services from third parties in Switzerland or abroad. Such outsourced activities remain under the responsibility and supervision of Swissquote to the extent required by applicable laws and regulations. These companies are obliged to comply with appropriate confidentiality regulations.

 

9.          Intellectual Property

 

9.1.      The content and layout of the Website are protected by copyright (all rights reserved) and other intellectual property rights held by us or certain third-party providers. Information provided on the Website may only be downloaded, printed or otherwise reproduced for personal, non-commercial purposes and provided that the copyright notes and other designations regarding proprietorship are retained. Any trademarks, including but not limited to those mentioned, are our property and nothing on this Website should be construed as granting any right or permission to use any trademark, logo or trade name without the prior written permission of the rights holder.

 

10.       Proper use of the Website

 

10.1.   You undertake to use the Website in a proper and reasonable manner, and not to misuse the Website in any way or use it in a way that might cause harm to Swissquote, Shopify, our commercial partners or to other users of the Website. In particular, you undertake not to:

·       engage in “email bombing”, denial-of-service attacks (in particular flooding), or any action which may result in the injection of malicious code in the Website;

·       circumvent or attempt to circumvent or to disable or attempt to disable the Website’s security features;

·       perform systematic retrieval of content from the Website (including robots, crawlers, automatic devises or manual processes).

 

11.       Linked websites

 

11.1.   The activation of certain links on the Website may cause you to leave the Website and go to websites, applications or resources operated by third parties, in particular for payment processing. We do not warrant or guarantee, either expressly or implicitly, the quality, pertinence, accuracy, completeness, update status, availability or legality of the content of these websites, nor shall we be in any way responsible for the products, services, information and other content displayed or offered via these linked websites. The same applies to third-party websites offering links to the Website.

 

11.2.   Furthermore, you must seek prior written approval from Swissquote before publishing a link from an external website to the Website.

 

12.       Applicable law and jurisdiction

 

12.1.   These Terms are exclusively governed by to Swiss law, without regard to any conflict of law provisions.

 

12.2.   The exclusive place of jurisdiction for any dispute arising out of or in connection with these Terms is Gland, Switzerland. We, however, reserve the right to take legal action against you in a court of competent jurisdiction of your place of residence or before any other competent court or jurisdiction. In such cases too, Swiss substantive law will apply exclusively.

 

13.       Other provisions

 

13.1.   Swissquote reserves the right to assign these Terms, inter alia, to an affiliate company. You may not assign or transfer your rights or obligations under these Terms.

 

13.2.   We may disable your access to the Website and/or your Swissquote Store Account (temporarily or permanently) at any time, including in the event you breach any of these Terms.

 

13.3.   In the event of one of the Terms being void, cancelled or rendered otherwise invalid, the validity of the remaining Terms shall not be affected or impaired.
